DEFINITIONS

Products are understood to mean clothing, accessories and all other items which are delivered by Notinaf. Buyer is understood to mean the legal entity or natural person that buys Products from Notinaf.

ARTICLE 1: LEGAL TERMS

The site notinaf.bigcartel.com is operated by Notinaf. The financial transaction as well as shipping of products sold is provided by Notinaf. Online shop by Big Cartel

ARTICLE 2: SALES CONTRACT

Sales between the parties are concluded and the property is acquired to the Buyer upon payment of the Product.

ARTICLE 3: PRODUCT INFORMATIONS

Notinaf satisfied its duty of advice and pre-contractual information. The products essential features are included in the detailed description that accompanies the photographs of the Products.

ARTICLE 4: PRICE AND PAYMENT

Prices include all taxes. Products are provided at the prevailing price at the time of placing the order. Payment is made by credit card. The payment data are not stored nor by Notinaf or Stripe, responsible for the financial transactions. The receipt of payment is immediate.

ARTICLE 5: PRICE AND DELIVERY TIME

For all delivery locations, charges are indicated at the time of placing the order. Delivery is ensured by Notinaf and carried out according to availability and in the order of arrival of orders. The delivery time varies by country of destination.

ARTICLE 6: UNAVAILABILITY OF GOODS ORDERED

If exceptionally, the Product ordered was no longer available, the Buyer may exchange the Product or be refunded without delay and no later than thirty days from the payment.

ARTICLE 7: QUALITY ARTICLE

The amount and quality of the delivered Products are those set at the time of placing the order. Notinaf reserves the right to change the goods to be delivered when the changes are related to technical development and they generate no price increase nor a deterioration in product quality, provided that the Buyer is free to mention the characteristics to which it subjects its commitment. Products sold by Notinaf are guaranteed new.

ARTICLE 8: NON-COMPLIANCE OF THE ORDER/PRODUCT DAMAGED

Notinaf is responsible towards the Buyer for the proper performance of obligations under the contract concluded at a distance, that these obligations are to be performed by the professional who concluded the contract or by other service providers, without prejudice of his right to appeal against these; secondly it can be exempted from all or part of its liability by proving that non-performance or improper performance of the contract is attributable either to the Buyer or to the unforeseeable and insurmountable, a third contract, or an act of force majeure.

In case of anomaly concerning the delivery, that is to say, in case of defective or non-compliant in kind (color reference error), the Buyer must promptly, ideally the same day of delivery, send its claims through the contact form . Any claim made beyond 14 days after delivery will not be accepted.

The absence of claim, the non expression of reservations by the Buyer means that the Product delivered is deemed satisfactory and will not be subject to subsequent dispute.

ARTICLE 9: CANCELLATION/RIGHT OF WITHDRAWAL

The withdrawal period is 14 days from the day of receipt of the Product. The exercise of this right is done via the contact form. The exercise of this right entails the refund of sums paid after qualitative and quantitative verification of the returned items.

ARTICLE 10: RETURNS

Return of means are initiated at the convenience of the Buyer and will be at disown expense. Notinaf can not be held to organize the return of canceled Products. The products must be in good condition and returned in their original packaging; they must not bear any traces of use, be accompanied by their accessories. Only after checking that these conditions are met, Notinaf will refund the amount of the returned Poducts. Otherwise, no refund can not be payable, the client will retain ownership of the product.

ARTICLE 11: INTELLECTUAL PROPERTY

All the texts, commentaries, articles, illustrations and images, whether visual or audio, reproduced on the website notinaf.bigcartel.com are protected under copyright, Trademark Law, Patent Law and image rights, and for the world. They are the full ownership of Notinaf. As such and in accordance with the Code of Intellectual Property, is authorized. Any other use constitutes infringement and is punishable under the Intellectual Property.

ARTICLE 12: LITIGATION

Any contestations that may arise on the implementation and interpretation of these terms and conditions shall be brought before the courts of Lausanne, which will have exclusive jurisdiction.

ARTICLE 13: MISCELLANEOUS

These conditions take effect from the 21st July 2016. Notinaf reserves the right to modify certain elements of these terms at all time.
